When the "founding fathers" ratified the constitution the life expectancy was 50 years. Today it's closer to 80. Of the first 10 justices only 2 stayed on the court longer than 14 years. If they knew then that people would routinely live to 80+ and that they would stay on the court until death, they most assuredly would have added term limits to their tenure.

Life expectancy is a weird number. It includes child mortality. But as soon as you pass the age or 15, you're basically set for 70s, even centuries ago. Especially when you're talking about easy jobs like being a politician or judge.

So I don't think you can point at that

Better late than never, but just barely. I’ll never understand how Dems failed to do this when the writing was on the wall 3 years ago and they had the numbers to pass it.

You realize that getting it through Congress isn't even half the battle right? It would then go to the states, where 3/4ths have to ratify it. That means 38 states have to ratify it. How long do you suppose that would take?

Would it be simpler to just nominate 4 additional Scotus than seek an amendment to challenge the decision that placed one person above the other?
