No, but if the arson gets their *** kicked by a red-blooded American, they should be able to take legal action.

 @9TSHDCTLibertarian from Arkansas  answered…8mos8MO

No, but if the flag belongs to someone else they should be held accountable for damaging someone else's property.

 @9N2Y2TGLibertarian from California  answered…12mos12MO

It shouldn't be illegal for someone to burn their OWN flag but they should be punished for burning someone else's flag on their own property or person.

 @9LJR8H9Libertarian from Texas  answered…1yr1Y

Yes, I am a proponent of free speech but the burning of the flag is a treasonous, threatening gesture potentially leading to the incitement of violence

 @9LG4NJWLibertarian from Texas  answered…1yr1Y

Yes, but only US overseas enemies, such as Russia, China, North Korea, Iran, etc. etc. and any western backed flag or a country that is facing genocide should also be illegal to burn for example, Ukraine

 @9JW29C3Libertarian from Indiana  answered…1yr1Y

Yes, but it can not be protected by law without a constitutional amendment, as it is currently protected by free speech / expression.

 @9J24H3WLibertarian  from Colorado  answered…1yr1Y

No, but it should be deemed “fighting words” and if the person burning the flag gets beat up (not killed) that should also not be illegal.

 @9FJSMB3 from Illinois  answered…2yrs2Y

 @9FHKL8BLibertarian from California  answered…2yrs2Y

I believe the flag does not represent what it should and it is a violation of freedom of speech to be illegal to burn the flag.

Only if our president is a tyrant and military and cops don't serve American citizens and protect us. And we have to fight back . If we ever turn to communism. Then yes.

A Supreme Court Ruling (5-4) split, stated it was protected free speech. It is a hard split between Eastern and Western cultures to allow flag burning, especially in Europe. I feel this unacceptable.

 @93K9QPRLibertarian from Virginia  answered…3yrs3Y

No. I hate it but it’s freedom of speech. People can do the same for the LGTBQ flag

 @93GPSBKLibertarian from Arizona  answered…3yrs3Y

It is legal to burn the flag, that's how you dispose of it according to the flag laws.

 @93FLWSDLibertarian from Kentucky  answered…3yrs3Y

Yes because it represents rebellion against this country's government. It's a symbol of you wanting to burn this country down.

 @93BWMKZLibertarian from Minnesota  answered…3yrs3Y

No, it has been confirmed by the SCOTUS to be protected under the 1st amendment

 @92QMW4NLibertarian from Michigan  answered…3yrs3Y

If the american flag represents our country, in all its *** backwards, corrupted assinine ways, burning the flag should be allowed. It, much like free speech, is an idea of changing the system that is designed to keep people struggling

 @8ZJSC48Libertarian from Wisconsin  answered…3yrs3Y

 @8YW33FNLibertarian from California  answered…3yrs3Y

If it is a government flag then yes. Otherwise if it's one bought purely for the act of burning it then no.

 @8YVHSGRLibertarian from California  answered…3yrs3Y

If they burn a government flag then yes but if it's from like Costco then whatever.

 @8Y2TP37from Maine  answered…3yrs3Y

 @8XYLN3TRepublican from Utah  answered…3yrs3Y

yes but only when retiring the flag, and it should be done with reverence and respect

 @8XTKPXBRepublican from Michigan  answered…3yrs3Y

 @8WY8N57Libertarian from Indiana  answered…4yrs4Y

No, the military protocol for if the flag touches the ground, it is to be burned because it has been tainted. I don't respect anyone who does it but they have the right to do so.

 @8WTWN7XLibertarian from New York  answered…4yrs4Y

No, You would not be able to burn the flag and hate your country if you didn't live in a free society. Thus making the act an act of ignorance and disrespect for freedom.

 @8W47WYXLibertarian from Florida  answered…4yrs4Y

If the person bought it and didn’t steal it from someone then they should be allowed to in protest.

 @8W3VZWL from Illinois  answered…4yrs4Y

It would be a violation of free speech, but it's also how we formally dispose of retired flags.

 @8VDDW53Libertarian from Massachusetts  answered…4yrs4Y

 @8TDGGCTLibertarian from Illinois  answered…4yrs4Y

 @8TB532Z from Arizona  answered…4yrs4Y

As long as it's done to honor a flag that has been damaged and you follow all rules that dictate the burning of the flag

 @8TB22CC from Virginia  answered…4yrs4Y

You should only be able to burn the flag if it is for a traditional ceremony.

 @8T9YC8V from Missouri  answered…4yrs4Y

 @8T8GGS6Libertarian from Illinois  answered…4yrs4Y

It should not be illegal, however in a sense, it is kind of treasonist and disrespectful to the country you live in, if anything, burn confederate flags as they do not symbolize culture.

 @8SXJW8FLibertarian from California  answered…4yrs4Y

If using the "N-word" is hate speech, and banned, then burning the flag is 1000x worse.

  @votegreywolfIndependent from Washington  answered…4yrs4Y

No. The US Flag Code includes burning as an acceptable method to retire a flag

 @8RVHZPF from Illinois  answered…4yrs4Y

yes, only if it it is not the person doing the act's property or is public property. (destroying someone else's property) it should come at a higher price of punishment, if so. They should be able to do what they want if it is their own. (free speech) if it is on property that would impose a safety issue or is not allowed, then those rules/laws would be addressed.

 @8RLDYKGLibertarian from Michigan  answered…4yrs4Y

 @8RBHZHMLibertarian from Texas  answered…4yrs4Y

burning a flag is just retiring a flag for no reason, i believe it should be illegal to desecrate the flag

 @8R9VJDY from Tennessee  answered…4yrs4Y

Yes, except as proper honorable retirement of a flag, and this should affect all nations.

 @8R84D66 from Pennsylvania  answered…4yrs4Y

 @8R5LXYG from Maine  answered…4yrs4Y

I personally don't like it, but if people want they have the right to do so

 @8Q8V97HLibertarian from Indiana  answered…4yrs4Y

No, but the flag must be burnt properly, in order to ensure safety and honor.

 @8Q7V53MLibertarian from Colorado  answered…4yrs4Y

No, because I would never burn the American flag, but part of what makes America so great is that we have that freedom.

 @8PFH2PXLibertarian from Kentucky  answered…4yrs4Y

Per regulations, the flag should be burned upon retiring it or turned into the VFW for them to perform the ceremony.

 @8P2L7FLLibertarian from Alabama  answered…5yrs5Y

you should have to apply to burn a flag and have restrcitions like you cant do it on the day of a miltary funeral

 @8NZZVBFLibertarian from Texas  answered…5yrs5Y

yes. My reasoning is that any American citizen has rights under the Constitution, but, they lose those rights when they put the rights of others in danger. For example, burning the American flag puts the life of others present in danger, thus, it should be illegal.

 @8MX7PLCLibertarian from North Carolina  answered…5yrs5Y

It should not be illegal, however I would not respect the burning of any nations flag.

 @8LJFGD7Libertarian from California  answered…5yrs5Y

Depending on the situation. To retire a flag you must burn it in a ceremony but out of hate it should be illegal

 @8J46SPRLibertarian from New Mexico  answered…5yrs5Y

No people should be allowed to do what they please as long as they do it in the right way.

 @8GN9NKPLibertarian from Maryland  answered…5yrs5Y

Yes, it should be illegal to burn any national flag and it should be an act of treason.

 @8G3XW2VLibertarian from Ohio  answered…5yrs5Y

 @8FNCN9H from Florida  answered…5yrs5Y

No, this is the proper way to dispose of flags that are too worn for service.

 @8DW42LVLibertarian from Iowa  answered…5yrs5Y

No, flag retirement/burning ceremonies involve burning old, torn, and worn out flags in a respectful manner.

 @8CVVWRFLibertarian from Alaska  answered…5yrs5Y

I believe so however certain Amendment's prevent that unless you want to bring up hate speech which you could apply some parts there if you word it correctly.

 @8CSVS63Libertarian from Texas  answered…5yrs5Y

it should be illegal to burn any nations flag. but if the flag doesn't represent what it should, then there's no point in wanting it.

I don't think it should be illegal but I can understand the difference of respect and immunity. Some american citizens are oppressed and still being oppressed. sometimes to be heard you have to do something eye drawing

 @97NKFS7 from Indiana  answered…3yrs3Y

No, in order to properly get rid of a tattered flag is to burn it other than that yes.

 @9733FSGLibertarian from Pennsylvania  answered…3yrs3Y

I do not believe it is right to burn any country's flag, but it removes freedom

 @9446422Libertarian from Michigan  answered…3yrs3Y

 @3RTRQGHLibertariananswered…5yrs5Y

Not as long as the flag being burned is owned by the person burning it.
