Should it be illegal to burn the American flag?
In 2006, the U.S. Senate rejected a Constitutional Amendment which would have allowed Congress to pass legislation prohibiting the burning or desecration of the U.S. flag. The Flag Protection Act of 2005 was introduced by Senators Bob Bennett (R-Utah), Hillary Clinton (D-NY), Barbara Boxer (D-CA), Mark Pryor (D-ARK) and Thomas Carper (D-Del). The Act proposed a punishment of up to one year in jail and a fine of no more than $100,000.

No, if it's your own property you have the right to burn it, but if it's public property or the property of others then yes.

It should only be illegal if it is a fire hazard, if the flag is not owned by the person burning it or the act of burning the flag is harming others by way of fumes or it is done in an area where fires are not permitted. If there is a threat made of harming others in connection with burning the flag, the person(s) making the threat should be prosecuted for the threat itself.

No if it's your flag, however if it's a public flag or someone else flag there should be charges if they owner wishes to press them.
