there are reasons to like putting a worn down flag to rest, but making it illegal is a violation of free speech

I think if you are retiring the flag than it is okay. However if you are doing it as an act of defiance than that is like a hate crime and you should be punished for that.

It should be illegal if burned with hostile intentions and if burned without proper respect and gratitude shown.

It is legal to burn the flag when it is no longer fit or can no longer go on a flagpole. It is the most dignified way of disposing of a well used flag.
