Yes, but they need to have legitimate proof as to why the believe someone is a terrorist. It can't just be because "they look like a terrorist"

Yes and No. I've heard that the patriot act can only supervise and monitor in foreign countries, not our own. But I know that the government is abusing that act to a certain extent because they are monitoring within the US as well.
