No, being an "illegal" immigrant in itself is essentially a trumped up charge since the crime is basically just existing without a visa, (permission to exist). They should only be arrested for the level of crime they individually committed and kept at the appropriate jurisdiction level.

If they aren't in the process of citizenship, or have some sort of authorization, then there should be regulation for that. Other than that, if they are caught for a crime, the government should of course give them their unalienable rights as well as give them due process. They should have terms for offence in their authorization if they have it. Or they could be fined if it is not there, and therefore sent to a rehab/authorization center at their embassy, as well as await a sentence for their crime, still obeying constitutional law.

Immigration reform as a whole is needed, however all illegal immigrants are illegally here. Whether we care about them or not they are still here illegally and should be sent back to go through the proper channels
