only if they are at fault, if they didn't do a clear background check or were neglegent. I think if the person seemed okay, and the gun people genuinely didn't see an issue with them having a gun, how are they supposed to be at fault

 @B566DBY from South Dakota  answered…1mo1MO

I think they should investigate the seller, because if the seller didn't go through a whole background check and meet the legal requirements to sell the gun on the person they are selling to then you could sue them.

 @B3ZTT5N from South Dakota  answered…3mos3MO

If they didn't do the proper check and check that the person is good enough to actually get a gun then yes, but if the person passes the test and the dealer does his job right then no.

 @B3X2D6R from South Dakota  answered…3mos3MO

No, because if they knew it was gonna be used for gun violence, they probably wouldn't have sold them the gun.

 @PKhaos  from South Dakota  answered…3mos3MO

Yes, if the dealer's have reason to believe that it will be used in a crime or if the marketing of a firearm is toward illegal activity.

 @B2SHVWQ from South Dakota  answered…4mos4MO

No, unless they gave a gun to a guy who wasn't mentally competent and shouldn't have a gun in his hands.

 @9VH9LRQ from South Dakota  answered…8mos8MO

Yes, but there should be a thorough investigation on the dealers and how easily they let the person purchase the gun

 @9TR5W2H from South Dakota  answered…9mos9MO

It's not the dealers' fault that someone use their gun for violence unless it is the dealer's intention

 @9HP2BFG from South Dakota  answered…1yr1Y

Yes, but with further investigation of how the gun was purchased whether a background check was done and was if bought legally

 @8RB494Q from South Dakota  answered…4yrs4Y

No! And if you think they should be liable, then then we need to make vaccine companies and doctors liable as well.

 @96DG637 from South Dakota  answered…3yrs3Y

the dealer shouldn't be trialed but there should be an option for it and even nat that poin why wouldnt you just sue the shooter themselves

 @96CVS5B from South Dakota  answered…3yrs3Y

Only if its found they are promoting their guns knowing they will likely be bought by individuals who intend to use them for criminal purposes.

 @8ZKY535 from South Dakota  answered…3yrs3Y

Yes, in instances where the dealer was the most at fault (ex if someone not qualified for a firearm and are allowed to get one anyways).

 @8ZKRKZ4Women’s Equality from South Dakota  answered…3yrs3Y

yes but also no because they obviously have trauma but putting people who weren't involved out of business for no reason isn't really fair.

 @8ZKMJTD from South Dakota  answered…3yrs3Y

 @8ZGPFB7 from South Dakota  answered…3yrs3Y

 @8YSRKPG from South Dakota  answered…3yrs3Y

No, it's not their fault as they have no say in what the buyer can or will do with it.

 @8Y8RK6Z from South Dakota  answered…3yrs3Y

 @8Y2RX7W from South Dakota  answered…3yrs3Y

I don't think they should be sued if they are being careful about who they are selling to. If they are not careful and they know something is off, they should be held responsible in a partial way.

 @8XVZWJC from South Dakota  answered…3yrs3Y

No, They are't the ones who did the shooting you cant blame the company and dealers for a shooting cause they weren't invovled with the shooting

 @8XG9MTV from South Dakota  answered…4yrs4Y

Depending on what happened yes and no. Because you can either be the dealer or the businessman and both got bad deals.

 @8X54HQYLibertarian from South Dakota  answered…4yrs4Y

 @8WSJB3G from South Dakota  answered…4yrs4Y

 @8WLFG5ZGreen from South Dakota  answered…4yrs4Y

People shoot people, not guns shoot people. The person who was operating the gun should be sued.

 @8V8ZZDMWomen’s Equality from South Dakota  answered…4yrs4Y

only if its a underage school shooter they should be able to sue the dealer.

 @8T3V7PZ from South Dakota  answered…4yrs4Y

I believe this hard issue because the only one that is reliable is the person who buying the gun knows what that person is doing.

 @8S7DPXK from South Dakota  answered…4yrs4Y

No, the gun doesn't pull its own trigger, and the manufacturer didn't either.

 @8S4SFWG from South Dakota  answered…4yrs4Y

If the dealer knowingly gave's a gun to a criminal then they both should get in trouble.

 @8RHP88D from South Dakota  answered…4yrs4Y

Yes but only if they fail to comply with background checks and other tests to make sure the person purchasing the gun complies

 @8RDFPLV from South Dakota  answered…4yrs4Y

No. If someone was a victim of gun violence, it is not the manufacturer's fault that it happened.

 @8RD5NVD from South Dakota  answered…4yrs4Y

 @8R3NB9N from South Dakota  answered…4yrs4Y

No they shouldn't since they didn't know but they could if they didn't do any checks and just sold it.

 @8R37S9W from South Dakota  answered…4yrs4Y

 @8P2CW8JRepublican from South Dakota  answered…5yrs5Y

No, It is not the gun manufacturers fault for what the person that purchased the gun decides to do with it.

 @8NP9PZC from South Dakota  answered…5yrs5Y

 @8NCBD8NWomen’s Equality from South Dakota  answered…5yrs5Y

Only if the dealer of the gun knew what the buyer was doing with the gun.

 @8N24PJNDemocrat from South Dakota  answered…5yrs5Y

Yes, If the person the gun was sold to was insane and or had a past criminal record. No, if the person the gun was sold to was not a criminal or insane.

 @8MT7CN5 from South Dakota  answered…5yrs5Y

I think if it was the dealers fault then yes but if it was just an accident then no.

 @8MQ7HFT from South Dakota  answered…5yrs5Y

 @8MQ66TD from South Dakota  answered…5yrs5Y

 @8MLPBRNDemocrat from South Dakota  answered…5yrs5Y

No, the dealers were only giving out the guns and probably didn´t know what people were using them for but if they did know sue them.

 @8ML9DPG from South Dakota  answered…5yrs5Y

I think that they should only be sued for weapon defects but not for how people use their products.

 @8MKF5XKWomen’s Equality from South Dakota  answered…5yrs5Y

somewhat because there should a background check to see if they were a criminal but if it was in self-defense then no

 @8LQ8CXR from South Dakota  answered…5yrs5Y

i think the person who did the crime should be sued but not the manufactures

 @8JJHLXJ from South Dakota  answered…5yrs5Y

no, because if they were to sue someone it should be the person that had it, it wouldn't be the sellers fault because they can't really assume what they are using the gun, they can mainly assume that it is self protecting or hunting animals.

 @8JHW9XQ from South Dakota  answered…5yrs5Y

yes if they didn't do a proper background check and handed it over to someone

 @8JHC7SY from South Dakota  answered…5yrs5Y

 @8JBVN73 from South Dakota  answered…5yrs5Y

The firearms dealers and manufacturers should be allowed to get sued, if their actions directly related to someone getting a weapon illegally (ex. dealer didn't run background check as they should have, perpetrator thus received gun illegally and then committed crime, then the dealer is liable)

 @8HYJLZKRepublican from South Dakota  answered…5yrs5Y

Yes, but only dealers who sell to criminals without conducting background checks, etc.

 @8HWBN3V from South Dakota  answered…5yrs5Y

No, this is not the firearms dealers and manufacturers fault. This was completely done by the suspect, and had nothing to do with who made the firearm, or who sold it.

 @8FVVCRK from South Dakota  answered…5yrs5Y

Crack down and put the blame on the shooters feet , not our rights, and not the manufacture.

 @8CVNJWF from South Dakota  answered…5yrs5Y

No because it wasn't the manufacturer of the weapon it was the single person who purchased that weapon and decided to use it for gun violence. That one person should be punished not the company where they got the weapon from.

 @8CKTB7CWomen’s Equality from South Dakota  answered…5yrs5Y

If they are an illegal firearm dealer, then yes. But people hurt other's with guns, not the actual guns.

 @9BG25SJ from South Dakota  answered…2yrs2Y

Guns don't shoot people. People shoot people so you cant blame a gun or the dealers, if someone shuts up a school that is on them and they should be in jail. The dealers should have to make they take a safety course and test to make sure they can have a gun

 @9B78LS6 from South Dakota  answered…2yrs2Y

Yes. If not compliant with current law or firearm tied to crime was illegally obtained.

 @9B3VS6F from South Dakota  answered…2yrs2Y

 @99YNXBS from South Dakota  answered…2yrs2Y

You can really go up to the manufacture and sue them for their product or even the dealer. They weren't the ones that shot the gun. But also depends on if the dealer was giving it to them to cause violence ( which is rare to find someone doing that). If they did then yes!

 @99VXW28Republican from South Dakota  answered…2yrs2Y

It is not the dealers fault that the gun was used for illegal activity. The dealer should do more background checks in the future.

 @99VNHNW from South Dakota  answered…2yrs2Y

 @98ZGZHCDemocrat from South Dakota  answered…2yrs2Y

No, the manufacturers and dealers are not the ones who are pulling the trigger.

 @98YN5TD from South Dakota  answered…2yrs2Y

they should provide proof that they went through all the regulations before selling the gun to that person

 @98FBN5C from South Dakota  answered…2yrs2Y

 @98F8RLG from South Dakota  answered…2yrs2Y

 @98F8P9R from South Dakota  answered…2yrs2Y

 @98F8HBKDemocrat from South Dakota  answered…2yrs2Y

They should have more of a background on that person than id there idea and legal rights.

 @98DBVLQ from South Dakota  answered…2yrs2Y

Sue the actual buisness or company, but not the employees working there.

 @98CVNP7 from South Dakota  answered…2yrs2Y

 @98CQ56Q from South Dakota  answered…2yrs2Y

No, it's the people who shoot, not the guns. There is a saying: "[weapons] don't hurt people, people hurt people."

 @984DNQT from South Dakota  answered…3yrs3Y

I think who every bought the gun and committed the crime should be responsible

 @97RZVQP from South Dakota  answered…3yrs3Y

 @97RZC2J from South Dakota  answered…3yrs3Y

 @96YLJFLPeace and Freedom from South Dakota  answered…3yrs3Y

i guess they could but you cant just sue for the gun the gun is a tool a weapon that has to have a user to be used so why sue the company of the weapon when the people who bought and used it be overpassed etc i guess.

 @8X4PLWS from South Dakota  answered…4yrs4Y

The gun is not what kills someone its the person behind it. Guns are used as tools so only can sue if there is a malfunction not a crime committed by someone else.

 @8P6YGV2 from South Dakota  answered…5yrs5Y

 @8LGMXJH from South Dakota  answered…5yrs5Y

yes, if the dealer illegally and does not do a thorough back ground check on the person buying the gun, they should be able to sue the dealer

 @8KL825N from South Dakota  answered…5yrs5Y

No, the dealers and manufacturers only sold the guns, not used them in the act of violence

 @8HX7DMNSocialist from South Dakota  answered…5yrs5Y

 @8GHK46P from South Dakota  answered…5yrs5Y

Yes, but only if the dealer sold it to someone with a violent record or mental illness

 @8G8BZ2K from South Dakota  answered…5yrs5Y

yes if the proper precautions were not taken when the purchase of the weapon was bought

 @philosopherkhaos  from South Dakota  answered…3mos3MO

Yes, but only in cases of negligence. Manufacturers and dealers should be held accountable if they engage in negligent practices, such as knowingly selling to prohibited buyers. However, lawful sales should not result in liability for crimes committed by third parties.

 @9BFLLWN from South Dakota  answered…2yrs2Y

I think the only time that they should sue the firearms dealer is if the dealer did not sell the gun properly. This should be if the gun that the dealer sold to a person did something bad to the victim.
