The U.S. Supreme Court has agreed to hear an appeal to last month’s 4-3 decision by the Colorado Supreme Court to exclude the former president from the state’s primary ballot on grounds that he engaged in insurrection on Jan. 6, 2021. Trump supporters believe that the high court’s conservative majority makes the case a slam-dunk in Mr. Trump’s favor. It’s likely that the justices will overturn the Colorado Supreme Court, but how they reach that decision is as important as what they decide.
Akhil Reed Amar, a Yale law professor and constitutional scholar, remarked in a recent podcast discussion that the court might opt for a minimalist ruling that defers to Colorado but doesn’t bind other states. It could decide that Mr. Trump was permitted to make his case for ballot access and lost, thus upholding the Colorado Supreme Court decision while still allowing other states with different ballot-access qualifications to go their own way.
No matter how the justices rule, millions of voters already have determined that the courts are playing an unwelcome role in the 2024 election. They believe that President Biden’s Justice Department has been loosed to go after his likely opponent in November. And they believe state efforts to keep Mr. Trump off the ballot are the backup plan. None of this is good for our democracy.

The Supreme Court should decide in favor of Trump because his Constitutional rights to a presumption of innocence and due process were flagrantly violated by Colorado and Maine.
If the Supreme Court decides AGAINST Trump, look for red states to remove Joe Biden from their ballots for his intentional violations of U.S. immigration laws!

Presumption of innocence and due process are only relevant in matters of civil and criminal law. Your constitution’s disqualification of Trump is a matter of constitutional law, so those factors do not apply.
The Colorado Supreme Court asserts that Trump violated his oath to our constitution. That makes his disqualification under it a matter of constitutional law.

For the thousandth time, Joe Biden did not rig the 2020 election. Donald Trump has been recorded trying to force votes to show up in Georgia. His own supporters in his inner circle have been jailed and convicted of felonies, and he is next in line, not because of an unconstitutional shadow government, but because he openly committed crimes.

That’s why I’d prefer the courts don’t throw him out because of the insurrection, but because of his criminal charges, so then we do have an unquestionable reason to rid him from the ballot.

I’d imagine the Supreme Court keeping him off would cause actual riots. Though, I don’t want him to run, I’d prefer that at least one of his criminal charges actually sinks in, and then he can be kept out for a stone cold reason rather than a shaky precedent.

"Overall, it seems to us to be quite clear that the specific series of events leading up to and culminating in the January 6, 2021 attack qualifies as an insurrection within the meaning of Section Three: “concerted, forcible resistance to the authority of government to execute the laws in at least some significant respect.”
