All citizens and inhabitants (residents) within a nation are under it's jurisdiction by law and hence have to undergo the same punishment with regard to the severity of a crime and this does not bar illegal immigrants however, the system must be reformed so as to pardon people with poor (uneducated, severely destitute , asylum seekers due to war, famine, calamity etc.) background on verifiable grounds. A poor immigrant or new immigrant child or juvenile should not be jailed or forced to undergo severe punishment for small thefts, instead they must be helped to get educated, financially stable and look after themselves. A democratic nation despite being a superpower is made of people and the first consideration should be the "people" not whether they are illegal immigrants, citizens etc. There should be no disparity.
