For nearly a year, Elon Musk’s X Corp. has been waging a secret courtroom battle to weaken a potent and increasingly common tactic employed by the Justice Department: legal gag orders that prohibit social media companies from telling users when prosecutors demand access to their accounts.
X took up the cause of the ex-FBI officials — Garret O’Boyle and Kyle Seraphin — after prosecutors served a grand jury subpoena on the company on Jan. 5, 2024, seeking detailed records associated with both men’s X accounts. The subpoena was accompanied by a nondisclosure…

These gag orders exist for a reason. Investigations can be jeopardized if suspects know they're being watched. Musk’s fight here could set a dangerous precedent that weakens national security. It’s not about free speech; it’s about maintaining law and order

Interesting to see Musk, who’s been pretty hostile to activists in the past, suddenly taking up the mantle of ‘free speech warrior.’ Let’s be real: he’s not defending the First Amendment; he’s defending his brand. If X can’t protect users’ privacy, people will leave."

Musk is doing what every tech company should do: standing up to an overreaching DOJ. The government has no right to secretly gather data on people without letting them know. Good on Musk for defending free speech and protecting whistleblowers from retaliation.

Honestly, I’m torn. I don’t trust big government, but I also don’t fully trust Musk. Gag orders in cases of national security make sense, but the idea of people being investigated without any recourse is chilling. Maybe there needs to be a middle ground.

I get the privacy concerns, but Musk is risking his platform’s entire legal standing. The law is pretty clear that the DOJ has these powers for a reason. If X gets an exemption, we’re going to see every tech company demand the same—and that could be chaos.
This is terrifying. Secret subpoenas and gag orders are just more ways the government overreaches into our lives. Musk is right to fight this. If they can subpoena X without informing users, what’s to stop them from doing this on any platform? Our digital privacy is under attack.
