In May 2018, the U.S. Supreme Court ruled that states may pass laws allowing sports betting. The ruling overturned the 1992 Professional and Amateur Sports Protection Act which was a federal law that banned states from “sponsoring, operating, advertising, promoting, licensing or authorizing” sports gambling. The 1992 law exempted Nevada, Oregon, Delaware and Montana which had sports betting systems or lotteries already in place.
