A state district judge struck down North Dakota's abortion ban Thursday, saying that the state constitution creates a “fundamental right” to access abortion before a fetus is viable. District Judge Bruce Romanick wrote in an order that the abortion law — one of the strictest in the nation — was too vague. The court concluded that pregnant women in the state have a "fundamental right to choose abortion before viability exists under the enumerated and unenumerated interests protected by" the state's constitution."The Court concludes [the law] violates the Constitution of the State of North Dakota and is void for vagueness and of no effect," the order stated.Romanick wrote that implicit in the right to personal autonomy, liberty and happiness is "a woman’s right and responsibility to decide what her pregnancy demands of her in the context of her life and in the context of her health.""Prior to viability, a woman must retain the ultimate control over her own destiny, her own body, and ultimately the path of her life," he continued. "A woman’s choice of whether or not to carry a pregnancy to term shapes the very nature and future course of her life, on nearly every possible level. The Court finds that such a choice, at least pre-viability, must belong to the individual woman and not to the government. "

Vice President Kamala Harris leapt to a six-point lead over former President Trump in the wake of last week's presidential debate, according to a Morning Consult poll published Tuesday. Most polls before last Tuesday's debate that saw Harris rattle Trump on a range of topics had the pair locked in a virtual dead heat.“A majority of likely voters — including 1 in 5 Republicans — believe Harris won the debate, and performance appears to be crystalizing her national lead over the former president," said Eli Yokley, political analyst at Morning Consult, in an emailed statement.Morning Consult pollsters surveyed 11,022 likely U.S. voters from Sept. 13-15 in the poll, which had an unweighted margin of error of +/-1 percentage point.Morning Consult notes that its survey showing support for Harris at 51% compared to 45% for Trump was a "new record" for the Democratic presidential nominee."Her 51% of support among likely voters, which is also at a record high, is driven largely by her best figures to date among Democrats, Biden 2020 voters, liberals, women, 18- to 34-year-olds and millennials," it said.

The relationship between Kamala Harris' team and Joe Biden's White House has been increasingly fraught in the final weeks before Election Day, 10 people familiar with the situation tell Axios.Biden's team wants Harris to win the election, but many senior Biden aides remain wounded by the president being pushed out of his re-election bid and are still adjusting to being in a supporting role on the campaign trail."They're too much in their feelings," one close Harris ally said of the president's team — a sentiment shared even by some White House aides.Driving the news: Some on the Harris team say that top White House aides aren't sufficiently coordinating Biden's messaging and schedule to align with what's best for the vice president's campaign.Biden gave an impromptu press conference in the White House briefing room Friday just as Harris was about to do an event in Michigan, ensuring that her event would get less TV coverage than it otherwise would have.Earlier in the week, Harris criticized Florida Gov. Ron DeSantis (R) for not taking her call about the recent hurricanes, only for Biden to praise DeSantis soon after for being "gracious" and "cooperative." (A person familiar with the situation told Axios that Biden hadn't been briefed on Harris' comments.)Biden has been eager to boast about a robust jobs report, helping to end the strike by the longshoremen's union and other perceived victories recently. Harris has been trying to focus on voters' pocketbook concerns, including inflation. One person involved with Harris' campaign told Axios: "The White House is lacking someone in the room thinking first and foremost about how things would affect the campaign.Harris' team has been trying to add staff to the vice president's official office to handle the bigger workload. It's been frustrated at the White House's pace in getting people detailed for that, according to two people familiar with the matter. The White House has been working to help Harris' team but has been frustrated by some of the rules about who can be detailed and when.

Barack Obama is urging Black men to step up their support for Kamala Harris, a sign that her campaign is worried about what is typically a reliable demographic for Democrats.Referencing reports that support for Harris is lagging among Black males, the former president gave what amounted to a scolding as he made an unscheduled stop at a campaign field office in Pittsburgh.“You’re coming up with all kinds of reasons and excuses, I’ve got a problem with that,” he said. “Because part of it makes me think— and I’m speaking to men directly— part of it makes me think that, well, you just aren’t feeling the idea of having a woman as president, and you’re coming up with other alternatives and other reasons for that.”
